Changes in healthcare financing increasingly rely upon patient cost-sharing to control escalating healthcare expenditures. These changes raise new challenges for physicians that are different from those that arose either under managed care or traditional indemnity insurance. Historically, there have been two distinct bases for arguing that physicians should not consider costs in their clinical decisions—an “aspirational ethic” that exhorts physicians to treat all patients the same regardless of their ability to pay, and an “agency ethic” that calls on physicians to (...) be trustworthy advisors to their patients. In the setting of greater patient cost-sharing, physicians' aspiration and agency roles increasingly conflict. Satisfactorily navigating the new terrain of consumer-driven healthcare requires physicians to consider these two roles and how they can best be reconciled so as to maximize quality of care while respecting the heterogeneity of patients' financial resources and willingness to pay. The development of natural theology in the Middle Ages was driven by the rebirth experienced by Western Europe beginning in the 1000s owing to the emergence of stable monarchies and reconquest of the Iberian Peninsula. This expansion gave scholars access to the vast libraries of scientific and philosophical literature held in Arabic cultural centres – libraries that contained Aristotelian works on natural, ethical, and metaphysical sciences, which had for centuries been lost to the Latin West. The new texts fed the (...) growth of universities, where secular interests helped shape the curriculum, as the centre of intellectual gravity shifted from the monastery to the town. This chapter examines the figures that represent various moments in the medieval tradition, during and after these developments. Anselm and Abelard immediately predate the universities and recovery of Aristotle. Aquinas and John Duns Scotus write on either side of the Condemnations of 1277. Raymonde of Sabunde's work first applies the expression ‘natural theology’ to Christian practice, and Yves of Paris seeks late into the seventeenth century to revitalize this project. In 1277, Stephen Tempier, bishop of Paris, drafted the famous Condemnation of 219 articles in theology and natural philosophy. This Condemnation was a reaction against a group of theologians, led by Siger of Brabant, who were accused of holding that truths of reason could contradict those of revelation. Writing before the Condemnation, which impugned reason's autonomy, Thomas Aquinas critiqued Siger and his followers, and argued that reason could never generate truths that contradict revelation. As a consequence, Aquinas sometimes dwells on (...) reason's limits, terming our knowledge of God 'equivocal' or 'analogical'. Sitting on the other side of the Condemnation, around the turn of the fourteenth century, John Duns Scotus was concerned to secure for reason a portion of its lost dignity. Accordingly, he explores what we can know of God, and lays claim to 'univocal' knowledge of him. Some scholars hold that Scotus's claim to univocal knowledge of God puts him at odds with Aquinas. In this dissertation, I argue that this is not the case, that this apparent discord is largely the result of their different enterprises rather than their basic beliefs about our natural knowledge of God, that Scotus's discussion of univocity is targeted not at Aquinas, but rather at Henry of Ghent---the leading light of the University of Paris at the time that Scotus studied there---and that Scotus does not believe that our knowledge of God is univocal in a strong sense, such that he would claim that it is wholly accurate. Rather, Scotus believes that, in this life, our knowledge of God must comprise abstract concepts that can never do justice to their source. This being the case, he has more in common with Aquinas than some would allow. (shrink)

[First paragraphs: This essay takes its practical orientation from my experiences as a member of a philosophy reading group on death row at Riverbend Maximum Security Penitentiary in Nashville, Tennessee. Its theoretical orientation comes from W. E. B. Du Bois’ lecture-turned-essay, “Criteria of Negro Art,” which argues that the realm of aesthetics is vitally important in the war against racial discrimination in the United States. And since, according to Michele Alexander’s critically-acclaimed The New Jim Crow: Mass Incarceration in the (...) Age of Colorblindness, the prison system should be the primary front today in this war, my essay’s ultimate aim is t/o articulate a new criterion of the present-day “Negro” art being created by a prison population that is still overwhelmingly constituted by persons of color. In my first section, I will show how Du Bois’ insights in “Criteria of Negro Art” remain relevant today, especially in the prison context, and argue that it is thus appropriate for my new criterion to be shaped by his distinctive conception of “propaganda.” In my second section, through a close reading of two texts by Michel Foucault (the pivotal thinker of modern imprisonment), I will flesh out this new criterion, “self-torsion,” defined as the effect of prisoners’ attempts at self-care within a prison system that distorts those attempts into further exploitation of both prisoners and the outside world that imprisons them. And my final section, in an attempt to illustrate this new criterion’s efficacy as a form of propagandistic resistance to contemporary racism, will deploy self-torsion as a critique of two artworks created by imprisoned members of my reading group at Riverbend penitentiary. Given the extraordinary influence of the DSM-III and its successors, the DSM-III-R and the DSM-IV, it behooves humanistically oriented practitioners to appraise these new manuals most carefully. Toward this end, we discuss the goals that have guided the manuals' development and provide an overview of their basic structure. This is followed by a phenomenologically based critique, evaluating the claim that these manuals are "descriptive" and "atheoretical." We conclude with a discussion of five guiding principles for phenomenological diagnosis and assessment.

The end of Benjamin Fondane's iconic poem, the ‘Préface en prose’, is inscribed at the entrance of Yad Vashem's Hall of Names. The quote is a resonant call to recognize the humanity of all victims in the poet's human countenance. This reference, among many other elements in this poem, prompts a comparison to Emmanuel Levinas's philosophy. The poem's speaker specifically resembles Levinas's ‘Other’. The venerable cities of the past, such as Venice or Amsterdam, convey a feeling of wholeness, an organic unity that surfaces in every detail, large and small, in restaurants, shops, public gardens, even in balconies and ornaments. But this sense of wholeness is lacking in modern urban design, with architects absorbed in problems of individual structures, and city planners preoccupied with local ordinances, it is almost impossible to achieve. In this groundbreaking volume, architect and planner Christopher Alexander presents a (...) new theory of urban design which attempts to recapture the process by which cities develop organically. To discover the kinds of laws needed to create a growing whole in a city, Alexander proposes here a preliminary set of seven rules which embody the process at a practical level and which are consistent with the day-to-day demands of urban development. He then puts these rules to the test, setting out with a number of his graduate students to simulate the urban redesign of a high-density part of San Francisco, initiating a project that encompassed some ninety different design problems, including warehouses, hotels, fishing piers, a music hall, and a public square. This extensive experiment is documented project by project, with detailed discussion of how each project satisfied the seven rules, accompanied by floorplans, elevations, street grids, axonometric diagrams and photographs of the scaled-down model which clearly illustrate the discussion. A New Theory of Urban Design provides an entirely new theoretical framework for the discussion of urban problems, one that goes far to remedy the defects which cities have today. (shrink)

Several writers have argued recently that optimal rules of law authorize morally suboptimal decisions in certain cases.1 Larry Alexander calls these “gap cases.”2 Should judges in gap cases defer to legal rules or deviate from them? Philosophers known as “formalists” favor deference, “particularists” favor deviation.

This slim volume contains a collection of eight essays that were originally given as lectures in 2002 under the aegis of the Society for Medieval Logic and Metaphysics. It is the second in a series of nine volumes published thus far, on subjects such as mental representation, free will, the ontology of individuation, the conceivability of God, skepticism, and nominalism. The title of the present volume is slightly misleading. Performing Madness: The Clinic as Stage. In the second half of the nineteenth century, clinical demonstrations became the dominant teaching method in psychiatry, playing a key role in medical‐professional disputes, as well. This paper traces this widely used though historiographically neglected practice of knowledge implementation and mediation, as demonstrated in the psychiatric clinic of the Berlin Charité (Psychiatrische und Nervenklinik der Berliner Charité) from 1881 to 1927. Documentation of this practice, found within individual medical records, forms the basis of this (...) research. The concept of ‘theatricality’ assists in uncovering the dramatic quality of the clinical demonstration: Psychiatric knowledge was not simply disseminated through such a practice; rather, such knowledge was first performatively created through the very logic of its presentation of exemplary patient histories, as well as through the examination and diagnostic positioning of its patients. The ‘success’ of such presentations depended on many variables, related to staff, time, place, and other situational factors. These include the presence of appropriate lecture halls, the availability and calculated selection of patients, and the employment of specific performative techniques by doctors for the sake of producing desired results. As one effect, clinical demonstrations also encouraged patients to both learn and rehearse behavior considered relevant to the particular diagnosis that was to be demonstrated. (shrink)

Drawing from each of these fields, in Origen and Prophecy, Clare Hall applies Origen's self-proposed (...) tripartite exegesis of Scripture, in which verses can be read at a "somatic, psychic, or pneumatic level," to his conceptualization of prophecy [End Page 293] (193). Hall's argument examines the "landscape of pagan, Jewish, and early Christian religiosity" and considers the "whole range of Origen's corpus" in relation to "wider structures and themes in his work" (4, 25). In doing so, Hall presents a compelling analysis embedding Origen's system of exegesis and theology of prophecy within the intellectual history of prophecy in the late classical and early Christian world.In her first few chapters, Hall explores Origen's definitions of prophecy in relation to its Jewish and Greco-Roman influences and his system of scriptural exegesis. Hall remains cognizant of terminology used by classical authors as she describes Origen's word choice, noting, for instance, that he varies his language most when the prophetic validity of the author is in question (9–12). She summarizes Greek, Roman, and Jewish conceptualizations of prophecy, then turns to Scripture and early Christian texts, all of which shape Origen's own "notions of wisdom, knowledge, and prophecy" (20, 29). Hall argues that Origen's On First Principles and homilies on Exodus, Leviticus, and Numbers are underlaid by a coherent exegetical system. Further, she explains, Origen's Commentary on the Song of Songs applies this same system to other forms of knowledge, including prophecy, which has a future-telling sense, a moral sense, and a mystical and revelatory sense (27, 50, 39–45). In her analysis, Hall provides insight into the philosophical and theological foundations for the "revelatory potential of allegory" as understood by Origen and other early Christian authors and carefully distinguishes Origen's own beliefs from the tenets of Origenism (30–31). To strengthen her argument, Hall cites a plethora of secondary scholars on Origen, including Caroline Bammel, Gunnar af Hällström, Robert Hauck, and Ilaria Ramelli (18–25).In her next few chapters, Hall unfolds Origen's system of distinguishing between true and false prophets and his advocacy for the unity of prophecy within Scripture in his response to Marcionism (199, 149–52). Chief among Hall's insightful contributions, however, is her treatment of the complex interrelation of prophecy and human autonomy: within Origen's framework, how does providential foreknowledge permit human free choice? To approach an answer, Hall traces the emerging conception of free will as "freedom of decision" among Greek authors such as Aristotle, Chrysippus and the Stoics, the Platonists, the Epicureans, and Alexander of Aphrodisias, who, she argues, laid the groundwork for Origen's "innovative narrative understanding of free will" in the context of "epistemological considerations surrounding prophecy" (55–71, 75). Research on the history of ethics has ignored Alexander Gottlieb Baumgarten miserably. And that even though Kant based his lectures on moral philosophy on Baumgarten's text books over the course of decades. This article takes up the cudgels for this "in ethicis" most independent follower of Wolff. In addition to Baumgarten's epistemological elevation of perception, which is known to have resulted in the new foundation of aesthetics as an independent discipline, his reception of two lines of tradition was primarily (...) decisive for an original further development of Wolff's basic approach. First, Baumgarten gave his practical philosophy a strong legal flavor through orienting it toward the natural law theory of his Jena teacher Heinrich Köhler. This legal character can be seen mainly in the then resulting predominance of the concept of obligation. Second, Baumgarten secularized the heritage of pietism in Halle by emphasizing the need for lively perception in order to act morally. Both with his orientation toward an ethics of duty, as well as with his highlighting of motivation, he laid the foundation for Kant's seminal transformations in this field.Die ethikgeschichtliche Forschung hat Alexander Gottlieb Baumgarten bisher sträflich vernachlässigt, obgleich Kant über Jahrzehnte hinweg dessen Handbücher seiner Vorlesung über Moralphilosophie zugrundegelegt hat. In this ambitious study, Alexander W. Hall examines the two preeminent figures of the golden age of natural theology: Thomas Aquinas and John Duns Scotus. Hall is not so much concerned with retracing particular proofs of the existence of God and derivations of the divine attributes—well-worn paths in discussions of medieval natural theology—as with investigating the larger philosophical issues that are raised by the project of natural theology, such as the nature of scientia and demonstrative arguments, and (...) accounts of signification and the meaningfulness of theological discourse.Hall's opening chapter offers an overview of natural theology in the High Middle Ages, summarizing the conclusions he will defend at greater length over the course of the book. In chapter 2 Hall relies primarily on Aquinas's commentary on the Posterior Analytics to get clear on his account of scientia, or scientific knowledge. "For Aquinas," Hall writes,"paradigmatic scientia is the result of syllogistic reasoning . . . Alexander von Humboldt’s depictions of mountain vegetation are among the most iconic nineteenth century illustrations in the biological sciences. Here we analyse the contemporary context and empirical data for all these depictions, namely the _Tableau physique des Andes_ (1803, 1807), the _Geographiae plantarum lineamenta_ (1815), the _Tableau physique des Îles Canaries_ (1817), and the _Esquisse de la Géographie des plantes dans les Andes de Quito_ (1824/1825). We show that the Tableau physique des Andes does not reflect Humboldt and Bonpland’s (...) field data and presents a flawed depiction of plant occurrences and vertical succession of vegetation belts, arising from Humboldt’s misreading of La Condamine’s description (1751). Humboldt's 1815 depiction, by contrast, shows a distribution of high-vegetation belts that is consistent with La Condamine’s description, while the 1824 depiction drops innovations made in 1815 and returns to simply showing numerous species’ names, thus not applying Humboldt’s own earlier zonation framework. Our analysis of contemporary reactions to Humboldt’s TPA includes Francis Hall’s posthumously published 1834 illustration of Andean plant zonation near Quito and Humboldt’s reaction to Hall’s critique. Throughout his work on plant geography, Humboldt disregarded some of his own observations, or confused them. At stake was his reputation as an innovator in the field of plant geography and a discoverer of the sequence of high-elevation vegetation belts on the world’s mountains. (shrink)

This article approaches a potential tension in the work of Slavoj Žižek between his critique of communist ideology and his endorsement of the communist idea. The aim is to show how this endorsement, in effect, emerged out of Žižek’s sustained engagement with communist ideology. The article captures this transformation by focusing on his understanding of the notion of the idea and the ways in which ideology can be transgressed. The conclusion drawn is that in moving from a Kantian to a (...) Hegelian notion of the idea, Žižek also leaves behind his initial Beckettian Leninism in favor of an understanding of revolution that no longer depends on the heroic act of a subject, but on the immanent logic of the communist idea. Dieser Artikel untersucht den zweideutigen Status der Rhetorik, der zwischen echter Philosophie und bloßer Sophisterei angesiedelt ist, anhand von Alan Badious drei exemplarischen Denkfiguren: dem Philosophen, dem Anti-Philosophen und dem Sophisten. Mit der jüngsten Rückkehr des Sophisten in die Politik in Form populistischer Politiker hat die zeitgenössische Rhetorikforschung die Notwendigkeit zum Ausdruck gebracht, dass die Disziplin ihr Bündnis mit der relativistischen Sophistik überdenkt. Indem Badious drei exemplarische Figuren untersucht und sie mit seinem Verständnis der drei Formen der Negation in Beziehung (...) gesetzt werden, untersucht der Artikel eine mögliche Kluft zwischen sophistischer Rhetorik und antiphilosophischem Populismus, die das vorherrschende Verständnis der Beziehung zwischen Rhetorik, Philosophie und Sophistik verkompliziert. Schließlich wirft der Artikel einige Fragen dazu auf, wie die Exemplarität im Allgemeinen und die drei exemplarischen Figuren im Besonderen in den Rahmen von Badious gesamter Philosophie eingeordnet werden können, und erörtert, wie man diesen Einschränkungen möglicherweise entgegenwirken kann. The old answers are no longer accepted; a dizzying array of options are offered in their stead. Underpinning this smorgasbord of lifestyles is a thicket of unquestioned assumptions, such as the separation of gender from biological sex, which not so long ago would have (...) been universally rejected as radical notions. In the spring of 2019, a group of Orthodox Christian scholars drawn from a wide variety of academic disciplines met together to offer responses to the moral crisis our generation faces, elaborating upon its various forms and facilitating a fuller understanding of some of its theological and philosophical foundations. In doing so they offer support to all those who question the claims that are so forcefully insisted upon today--a clarity that will aid them in standing up and resisting trends that have already shown to be the cause of great suffering and unhappiness. Avantgarde in Halle: The Invention of Aesthetics and the Aestheticization of Christianity. The foundation of scholarly aesthetics by the Halle philosopher Alexander Gottlieb Baumgarten and Georg Friedrich Meier in the middle of the 18th century took place within a milieu that was shaped by both pietism and the Enlightenment. Martin Fritz demonstrates that aesthetics in Halle itself can be considered a synthesis of pietism and Enlightenment ideas. The sensualization of basic Christian concepts is of eminent relevance for these aesthetics, (...) in order to reinvent the pietistic striving for intensive religious experiences through such „aestheticization.“ The romantic idea of „Kunstreligion“, which continues to be significant in cultural life today, is also based on this programmatic notion of aestheticization. (2019), there are UNBLELIEVABLE similar ideas to my ideas (2002-2008); in fact, the framework of this article seems UNBELIEVABLE similar to my framework, the EDWs perspective!!!! I applied my EDWs to quantum mechanics (getting micro-EW, wave-EW), to Einstein’s special relativity getting EDWs for those two observers (one in the train and one on the pavement), to microparticles and macro-objects (EDWs), etc. -/- The authors of this article work in an UNBELIEVABLE similar framework (see below details), and applied this framework to quantum mechanics referring to the relationship between two observers and the microparticle. In this way, they get EDWs for the same microparticle. However, I have done exactly the same application to Einstein’s special relativity. I emphasize that it would be necessary my EDWs to apply this framework to the same particle. In my book 2014, if the reader replaces the macro-objects with the microparticle, there would obtain exactly the EDWs for the microparticle that can be found in this article! Amazing it is the fact that the authors, having no background in philosophy and having no new theory on quantum mechanics, have discovered the existence of observer-independent “facts of the world” (that are exactly my EDWs!!!). Obviously, the authors are geniuses like sean carroll, markus Gabriel, carolo rovelli, and so many from my manuscript referring to UNBELIEVABLE similarities (see the bibliography at the end of this article!) . The scaling of body parts is central to the evolution of morphology and shape. Most traits scale proportionally with each other and body size such that larger adults are essentially magnified versions of smaller ones. This pattern is so ubiquitous that departures from it – disproportionate scaling between trait and body size – pique interest because it can generate dramatically exaggerated traits. These extreme morphologies are frequently hypothesized to result from sexual selection and their study has a long history, with (...) several hypotheses seeking to explain their evolution. Despite this effort, surprisingly little progress has been made in demonstrating the forms of selection that produce different scaling patterns or in identifying the mechanisms that underlie the expression and evolution of scaling relationships. Here we review recent insights regarding the proximate mechanisms that regulate and integrate trait growth and that offer a new framework for studying the evolution of morphological scaling. Both realist and anti-realist accounts of natural kinds possess prima facie virtues: realists can straightforwardly make sense of the apparent objectivity of the natural kinds, and anti-realists, their knowability. This paper formulates a properly anti-realist account designed to capture both merits. In particular, it recommends understanding natural kinds as ‘categorical bottlenecks,’ those categories that not only best serve us, with our idiosyncratic aims and cognitive capacities, but also those of a wide range of alternative agents. By endorsing an ultimately subjective (...) categorical principle, this view sidesteps epistemological difficulties facing realist views. Yet, it nevertheless identifies natural kinds that are fairly, though not completely, stance-independent or objective. (shrink)
